High Court Code of Conduct for expert witnesses New Zealand


Expert witnesses hold a specific role and are governed by the High Court Rules 2016, Schedule 4 Code of Conduct. With years in the NZ Security Intelligence Service and as a former NZ Police Officer, including ten years at the rank of Detective Sergeant, David is unwavering at meeting these requirements as outlined below;
Duty to the court
  • using expertise to provide impartial testimony
  • not an advocate for any party
  • to disclose remuneration for appearing at proceedings, if any
Duty to confer
In proceedings, it is David's sworn duty to confer and attempt to reach an agreement with other expert witnesses if directed by the court. Regardless of whether agreement is reached or not, you are bound to sign statements to that effect. 
Evidence of expert witness
  • acknowledge and comply with the code of conduct at all times
  • declare qualifications deemed relevant for the case
  • confirm the issues and evidence discussed are within his expertise
  • state the facts and premise my opinions are based upon, accompanied by sound reasoning 
  • note the information used to support his findings, including exams, tests or investigations
